Acceptance of Terms & Conditions |

These terms govern your use of Justsecretarialjobs.com.au's website ("the Website") and our relationship with you. Please read the terms carefully. By entering this Website or supplying an advertisement to us for display on the Website you acknowledge that you are bound by these terms. |

Obligations of the recruiter |

A. You undertake to comply with the provisions of and ensure that your actions do not put us in breach of the Data Protection Act 1984 and/or 1998 or relevant legislation with regard to any applicant information received by you and in particular to keep such information confidential and to use such information solely for the purposes of recruitment in connection with the relevant advertisements placed by you and in response to which the information was provided and not to pass such information to any third parties without the applicant's consent. |

B. You are responsible for ensuring that the content of any advertisement: |
|
1. is true and accurate;
2. complies with all relevant legislation and any applicable codes of practice in all applicable jurisdictions;
3. is not discriminatory, obscene, defamatory, or in any other way illegal and does not infringe the rights of any third party (including without limitation the intellectual property rights of any third party). |

C. You are also responsible for satisfying yourself as to the suitability and availability of any candidate whose CV is provided to you through the Website.
D. To pay any fees due in accordance with clause III below. |

Advertisements and Payment Provisions |
|
1. Each vacancy advertised by you (an "Advertisement") shall consist of no more than 500 words and any graphics must, in respect of size, be pre-authorised by us before such Advertisement is posted.
2. For each Advertisement you will be charged a fee on the following basis: |
|
a) if you are a Recruitment Agency, and will not be employing any respondent to an Advertisement direct then fees will be agreed between you and us from time to time and all fees will be exclusive of GST;
b) if you are an Employer, and are seeking respondents to an Advertisement to be employed either directly by you or by an associated or group company (as defined in the Companies Act), a fee of $100 or such other sum as agreed by us, exclusive of GST, will be due from you to us; per period of 30 days or part thereof for which an Advertisement is displayed on the Website ("Display Period").

3. If the vacancy to which an Advertisement relates is filled during the course of the Display Period which you have paid, you will be entitled to use your Advertisement to display another single vacancy for the remainder of that Display Period.
4. Payment for the first Display Period is due upon order by credit card or in such other manner agreed, such alternative arrangement in respect of payment shall in any event be due within 14 days of commencement of such Display Period.
5. Save where such payment is to be made for the first Display Period, payment for each subsequent Display Period is to be made at least 14 days prior to the commencement of such Display Period.
6. If payment for a Display Period is not received in accordance with clause III 3 or 4 as applicable. above then, in addition and without prejudice to our rights in clause IV, we reserve the right to remove such Advertisement. |
| IV. |
Right to remove |
|
We reserve the right to, at any time, remove your advertisements and/or any information supplied by you from the Website at our discretion or to change the size or position of the same and/or to terminate the provision of services to you forthwith and thereby terminate any responsibility we may have toward you under the these terms and conditions or otherwise. |

Intellectual Property |
|
Unless otherwise indicated please note that all copyright and any other intellectual property in the Website, its contents and "look and feel" belong or are licensed to Justsecretarialjobs.com.au. |
| VI. |
Liability |
|
Notwithstanding any other provisions in these terms, we do not limit our liability for personal injury or death caused by our negligence, however please note the following:
1. We shall not be liable for any losses you may make which result from your use (or inability to use) the Website including but not limited to damage to your hardware or software due to any viruses or cookies transmitted therefrom or otherwise, loss of copy, artwork or other data, Advertisements or other materials which you supply to the Website;
2. In providing the services offered on the Website justsecretarialjobs.com.au may use information provided to it by you and/or third parties (including prospective employees). Justsecretarialjobs.com.au will use all reasonable endeavours to ensure the reliability of any third party sources but Justsecretarialjobs.com.au.com accepts no liability for the accuracy of the information (including but not limited to the information set out in applicant's CVs) provided to it;
3. Justsecretarialjobs.com.au makes no warranty or representation that it has verified any of the material on this Website or has vetted any applicant;
4. You acknowledge that you are responsible for the conduct of all interviews with applicants, taking up references, work permits etc and that we are not responsible for the performance or conduct of any applicant.

Indemnity |

You agree to indemnify us and to keep us indemnified in respect of all damages, costs, liabilities, expenses or damages that we may incur arising from your use of the Website and/or content of your advertisement(s), including but not limited to:
1. the publication of any defamatory or obscene statement;
2. breach of copyright or any other third party intellectual property right;
3. any claims made by any person in respect of race, religion, age, sex or disability discrimination. |

Third Party Rights |

IX. Contracting Party Justsecretarialjobs.com.au is a trading division of Just Online Group Pty Ltd whose registered office is at 5/10 Tuckwell Place, North Ryde, NSW 2113.
X. Governing law and jurisdiction Use of the Website and these terms shall be governed by, and construed in accordance with, the laws of Australia and each party irrevocably submits to the exclusive jurisdiction of the Australian courts.
